Lemon Law Basics – Each state has “lemon laws” to protect consumers from unforeseen defects or mechanical problems with newly purchased cars. You may make any arguments to the arbitrator(s) you think necessary to support your complaint, including those based on the lemon law. Auto lemon laws provide automobile (car) owners with an automatic warranty that gives them certain rights. Consumer goods are defined as products which are used, bought or leased for use primarily for personal, family, or household purposes.
Cars, boats, recreational vehicles, motorcycles and motor-homes are generally covered by the lemon law. These vehicles must have problems covered by a written factory warranty; claims must be filed within 6 months of the expiration of the warranty, 24 months, or 24,000 miles, whichever comes first. The law requires 2 repair attempts in the first 12 months or 12,000 miles and another 2 attempts in the second 12 months or 12,000 miles. A vehicle may be a lemon and subjected to a buyback even if it does not fall under a presumption.
Different Lemon Law requirements, limitations and procedures apply to motor homes from those applying to other types of new vehicles. Under the Lemon Law, if you wish to claim a refund or replacement you must give written notice by certified mail to the manufacturer and its dealer or repairing agent.
